Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the DeepSkyLog application and website (the “Service”) operated by DeepSkyLog (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

2. Service Description

DeepSkyLog provides a cloud-based platform for managing astrophotography data, including:

Storage and organization of FITS image metadata
Project and session tracking
Equipment and location management
Collaboration tools for team imaging projects
Mosaic planning and visualization
Integration with imaging software like NINA

The Service is provided on a subscription basis with different tiers offering varying features and capabilities.

3. Subscription Plans

3.1 Free Tier (Hobbyist)

Unlimited projects and frames
Basic features at no cost
No credit card required

3.2 Paid Tiers (Enthusiast & Observatory)

Additional features as described on our pricing page
Billed monthly or annually
Requires valid payment method
Subject to applicable taxes

3.3 Billing

Subscriptions are billed in advance on a monthly or annual basis
All fees are non-refundable except as required by law
We reserve the right to change pricing with 30 days notice
Failure to pay may result in service suspension or termination

4. Data Ownership and Privacy

4.1 Your Data

You retain all ownership rights to your astrophotography data, images, and content uploaded to the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

4.2 Data Storage

We store FITS file metadata, not the actual image files
You are responsible for maintaining backups of your original image files
We employ industry-standard security measures to protect your data

4.3 Data Portability

You may export your data at any time using our data export features.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or to violate any laws
Attempt to gain unauthorized access to any portion of the Service
Interfere with or disrupt the Service or servers
Upload malicious code, viruses, or harmful content
Harass, abuse, or harm other users
Use the Service to spam or send unsolicited messages
Impersonate any person or entity
Scrape or harvest data from the Service without permission
Resell or redistribute the Service without authorization
Upload content that infringes on intellectual property rights

6. Collaboration and Shared Projects

6.1 Team Projects

Project owners control access and permissions for collaborators
All collaborators must comply with these Terms
Data shared in collaborative projects is subject to project-level permissions
Collaborators may contribute data to shared projects

6.2 Responsibilities

Project owners are responsible for managing team member access
All team members are responsible for their contributions and actions

7. Intellectual Property

7.1 Service Content

The Service and its original content (excluding user-uploaded content), features and functionality are and will remain the exclusive property of DeepSkyLog and its licensors.

7.2 Trademarks

DeepSkyLog and related logos are trademarks of DeepSkyLog. You may not use these trademarks without prior written permission.

7.3 Feedback

If you provide us with feedback or suggestions about the Service, we may use such feedback without any obligation to you.

8. Third-Party Integrations

The Service may integrate with third-party services (such as NINA, Aladin sky viewer, weather services, etc.). Your use of such integrations may be subject to their respective terms and conditions.

We are not responsible for the availability, accuracy, or reliability of third-party services.

9. Disclaimers

9.1 Service Availability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DO NOT WARRANT THAT:

The Service will be uninterrupted, timely, secure, or error-free
Results obtained from the Service will be accurate or reliable
The quality of the Service will meet your expectations
Any errors in the Service will be corrected

9.2 Astronomical Data

The Service provides tools for managing astrophotography data. We do not guarantee the accuracy of astronomical coordinates, catalog data, weather forecasts, or other astronomical information provided through the Service.

10. Limitation of Liability

IN NO EVENT SHALL DEEPSKYLOG, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Indemnification

You agree to defend, indemnify and hold harmless DeepSkyLog and its licensors and licensees, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from:

Your use and access of the Service
Your violation of any term of these Terms
Your violation of any third party right, including intellectual property rights
Any claim that your content caused damage to a third party

12. Termination

12.1 By You

You may terminate your account at any time by:

Using the account deletion feature in the application
Contacting us at support@deepskylog.com

12.2 By Us

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

Your right to use the Service will immediately cease
If you wish to retrieve your data, you must do so before termination
We may delete your data after 30 days of account termination

12.3 Survival

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor or materials.

17. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
